In our nearly four year existance, we've been stolen from countless times. Luckily it'll rarely happen at big boards anymore since we basically have eyes everywhere.
Though with Jason out of the hacking scene these days it'll be harder to monitor there.

About all the sprite and artwork theft that's going on with this, why don't you guys put something up on the website? You might as well officially copyright everything you're using. That way if stuff gets stolen and someone puts out a game before you guys, you can sue, or get credit where it's due.

We can't actually copyright it, for one what country? There's also that it's going into a game by Nintendo (well, based heavily on a game by nintendo). Threre's lots of thorny legal ground, and it's really better just to ask them to stop or appeal to board owners.

Actually, you can. You necessarily have to copyright the game itself. Why not the parts? If you copyright your artwork specifically, or even the concepts of the Pokemon, you won't have that problem. The game itself can remain open-source.

Well. Jepe is LGPL licence, I think, which means it's open source but can be used in closed source products. We have to be very very careful what we copyright because, like I said, Nintendo will soon be breathing down our necks. I've only done a little bit of research into the laws about it (officially, this game is for research purposes), but really, copyrighting anything doesn't really stop people stealing it anyway. The law would be on our side, but would we really ever resort to lawyers? I think we're too lazy. If we start getting really bad problems with theft, maybe then, but so far all we've had to do is ask people to stop. It's not worth it really.

Well, you have a large community here, and your site comes up as one of the first results if you Google "Pokemon fangame." Copyrighting some artwork would not get you in trouble. It's just like any drawing at all. The concept is reserved to you guys if you do that.
Leaving your game's engine open-source is a good idea, too. I advocate that decision.
Even if you didn't actually go forth to act on the art thefts with lawyers, you'd still have the option if someone puts out a game with your artwork in it. And you have that threat to deter people from doing it. It would be a good negative incentive against it.

Let's just put them in jail and end this story. You can't do that without legal evidence that you're the first to come up with the concepts and that you have the rights to them. It's not that simple, unfortunately.
